APPEAL COURT RESOLVES IN FAVOR OF SAMSONITE IN TRADEMARK DISPUTE

The Industrial Property Court accepted that Samsonite registered in Chile “American Tourister Since 1933”, the famous line of suitcases with worldwide coverage.

This despite the fact that the Chilean Trademarks Office had rejected it for being previously registered the trademark “Tourister” owned by a third party.

Represented by Claudia Varas, Intellectual Property attorney, Samsonite decided to appeal and prove the fame, notoriety and international use of this trademark along with its worldwide known design (blue, white and red), making it clear that both signs could coexist without misleading the public consumer.
