IMPLEMENTATION OF TRADE MARKS LAW TREATY (TLT) REQUIRES NOTARIZATION OF POWER OF ATTORNEYS

Please note that, according to new regulations of our Patent & Trade Marks Office, upon practical implementation of the Trade Marks Law Treaty (TLT) towards its harmonization with Chilean General Legislation so as to avoid the parties coming into jeopardize, all Power of Attorneys must be authorized by a Notary Public, being necessary that the person executing the document, does so on behalf of the Company (legalization up to the Chilean Consul is no longer required).

In addition, we must prevent you that this simplified execution of Power of Attorney, only applies to the administrative prosecution of trademark and patent applications, but could be successfully objected upon entering into litigation proceeding both, before our Patents and Trademark Offices and   other Courts, according to our Civil Procedure Code.

Accordingly, should your desire be not to grant an additional Power of Attorney, suitable for all kind of Authorities and Courts in Chile, our advice would be to have future Power of Attorneys duly legalized up to a Chilean Consul.
