MADRID PROTOCOL AND THE I.P. RIGHTS IN THE NEW CHILEAN CONSTITUTION

On April 4, 2022, the Chilean Government deposited its instruments of accession to the Madrid Protocol, which should enter in force on July 4 next.

 

On the other hand, it is a matter of concern that, while the government ratifies an important Intellectual Property Treaty that involves the protection of worldwide trademarks, in the preliminary approval by the Constitutional Convention of section referred to Property Rights, Intellectual Property Rights do not have, so far, an explicit and direct recognition, as it traditionally occurred in our previous Constitutions of 1833,1925 and 1980.
