VICTORY FOR NESTLE IN THE SUPREME COURT, IN THE WORLD TRADEMARK REVIEW

World Trademark Review has recently published an article by the Senior Advisor of Villaseca Abogados, Sergio Amenábar, titled: “Victory for Nestlé as Supreme Court recognises broader scope of protection afforded to famous marks”.

In the text, it is noted that: “On 24 December 2018 the Chilean Supreme Court reversed and replaced decisions issued by the Institute of Industrial Property and the Special Appeal Court. In doing so, it recognised the wide power of exclusion of famous trademarks, declaring that such exclusion goes beyond the products or services protected by such signs”. In this way, Nestlé (which registered the Gloria brand in Classes 5 and 29) prevented Gloria SA from registering Gloria Foods in Class 31.
